Can I Prevent a DCPP Caseworker from Entering My Home? Do I Have to Answer Their Questions?
You have a constitutional right to privacy in your own home, meaning you generally do not have to allow a DCPP caseworker inside without a court order. Law enforcement officers can enter your home without a warrant if there are exigent circumstances. These are readily apparent emergencies that call for immediate action and occur rarely.
Far more often, a DCPP caseworker will knock on your door and say they have a few questions. You are also under no legal obligation to answer questions from a DCPP investigator, and we strongly advise against doing so without legal counsel present. Parents often fear that their initial refusal to cooperate will be used against them and make them look guilty for something they have not done. The danger lies in the fact that innocent, well-intentioned explanations are frequently misinterpreted or twisted to fit a narrative of neglect.
